Summary

Justice Mullins, joined by the Chief Justice and Justice D’Auria, dissented from the court’s disposition concerning whether the victim’s injury constituted serious disfigurement. The dissent agreed with the majority’s definitions and relevant factors but concluded that a reasonable juror could find that the permanent, visible, one-and-one-half-inch scar requiring ten stitches substantially detracted from the victim’s appearance. The dissent therefore would have affirmed the Appellate Court’s judgment and did not reach whether the court should reconsider its existing precedent.
