Summary

Justice Kahn joins the majority's resolution of the evidentiary issues, agreeing that the trial court read the polygraph rule too broadly but that exclusion of the pretest interview was harmless, and agreeing that exclusion of the jailhouse-informant expert testimony was not an abuse of discretion. She separately emphasizes that portions of the interview revealing the polygraph context would remain inadmissible and that the trial court should have considered redaction or limited admission. Justice Palmer, joined by Justice McDonald, and Justice D'Auria concur in part and dissent in part, concluding that the videotape error was harmful; Palmer would also admit the expert testimony.
