Supreme Court of Connecticut
R.T. Vanderbilt Co., Inc. v. Hartford Accident & Indemnity Co.
October 8, 2019333 Conn. 343
Summary
The court affirmed the Appellate Court's resolution of the certified insurance-coverage issues. It adopted the Appellate Court's reasoning upholding a continuous trigger, an unavailability-of-insurance exception to pro rata allocation, the exclusion of expert testimony on the timing of asbestos-related bodily injury, and the limitation of pollution exclusions to traditional environmental pollution. It independently held that occupational disease exclusions unambiguously apply to claims by both employees and nonemployees who developed an occupational disease through work for other employers.
