Summary

The court held that the Federal Railroad Safety Act does not preempt the plaintiff's negligence claim alleging that the railroad negligently selected the track immediately adjacent to a station platform for a high-speed through train. Although federal regulations extensively govern track conditions, classification, and speed, they do not substantially subsume the distinct subject matter of selecting an interior or exterior track for a through train. The court therefore reversed summary judgment for the railroad and remanded with directions to deny its motion.
