Summary
The court held that a member of a single-member limited liability company may be covered as the company's employee under the Workers' Compensation Act without the company first electing coverage. It further held that the appropriate employee-status test is whether the member performed services for the company and was subject to the hazards of its business, not whether the company controlled the member's work. Because the plaintiff satisfied that test, the court reversed and remanded with directions to grant his claim for concurrent employment benefits.
