Summary

The court held that a transfer of a debtor's assets executed by the debtor's attorney-in-fact is a transfer made by the debtor for purposes of CUFTA because agency principles supplement the statute and are consistent with its text and creditor-protection policies. The court therefore reversed the judgment rejecting the fraudulent-transfer claim and remanded for a new trial on whether the transfers were fraudulent under the theories advanced. It affirmed the judgment on unjust enrichment because the plaintiff failed to prove a superior legal or equitable right to the transferred funds.
