Summary

The court held that a transfer of a debtor's assets made by the debtor's attorney-in-fact under a power of attorney may qualify as a transfer made by the debtor under CUFTA because agency principles supplement the statute and are not displaced by it. The court therefore reversed the judgment rejecting the fraudulent-transfer claim and remanded for a determination whether the transfers were fraudulent. It affirmed the rejection of the unjust-enrichment claim because the trial court's finding that the defendant had an interest in the funds was supported by the record and the plaintiff failed to show a superior legal or equitable right.
