The court held that a written agreement governing disposition of cryopreserved pre-embryos upon divorce is the appropriate first consideration and is presumptively enforceable between the progenitors. It concluded that the parties formed an enforceable agreement requiring discard of the pre-embryos because their signed and initialed storage agreement contained definite terms supported by mutual promises and performance. The court therefore vacated the award of the pre-embryos to the plaintiff and remanded for disposition under the agreement.
