Summary

This separate opinion agrees that the defendant’s drug-selling association satisfied the purpose and longevity elements of an association-in-fact enterprise, but disagrees that the evidence failed to establish sufficient relationships among the participants. It would conclude that the defendant’s coordination of multiple dealers, sharing of phones and drugs, use of a common location, and direction of sales supported the racketeering conviction. Justice Eveleigh, dissenting in part, would have reversed the Appellate Court’s ruling on the racketeering charge rather than affirming its conclusion that the evidence was insufficient.
