Summary
The court held that the defendant's conviction could not be sustained on the uncharged theory that his conduct endangered the child's mental health, but affirmed the conviction on the charged theory that he endangered the child's life or limb. The evidence permitted the jury to infer that the child was close to the gun and struggle, that the defendant's conduct created a dangerous situation, and that he acted with the requisite reckless disregard. The court therefore affirmed the Appellate Court's judgment on an alternative ground.
