Justice Espinosa dissented from the majority's conclusion that amending the information prejudiced the defendant or charged an additional offense. She would have held that the amendment merely conformed the interfering charges to the evidence because the defendant had notice throughout trial that the state claimed his interference continued from the motor-vehicle stop into the police station. The dissent maintains that the defendant fully litigated the station conduct and was not unfairly surprised. There are no separate opinions.
