Summary

Justice Espinosa dissented from the conclusion that the defendant's charitable contribution supported a nolle of all four criminal cases. She would have construed the disposition-hearing transcript as clearly providing that the contribution was exchanged only for dismissal of the drug case, while the other three cases were unilaterally nolled and could later be reinstituted. She therefore would have upheld the conviction and rejected the motion to dismiss. The dissent also reasoned that the defendant had not raised any claim of mistake concerning the legal effect of a unilateral nolle.
