Supreme Court of Connecticut

St. Pierre v. Plainfield

August 8, 2017

Summary

The court affirmed summary judgment for the town, holding that operating the municipal pool, including renting it to a private organization for a nominal fee, was a governmental rather than proprietary function and therefore did not abrogate discretionary-act immunity. The court also held that the plaintiff was not an identifiable person for purposes of the imminent-harm exception because he voluntarily attended the aqua therapy sessions. No separate opinions were filed.
