Supreme Court of Connecticut
Southwest Appraisal Group, LLC v. Administrator, Unemployment Compensation Act
March 21, 2017324 Conn. 822
Summary
The court held that part C of Connecticut’s ABC test does not require proof that a putative independent contractor actually performed services for third parties. Such work is one factor in a totality-of-the-circumstances inquiry, along with indicia of an independently established business. Because the board gave dispositive weight to the absence of third-party work despite other evidence of independent enterprises, the judgment was reversed and the matter was remanded for a new administrative determination.
