Summary

The opinion agrees that trial counsel reasonably chose to pursue a third-party culpability defense against one individual rather than another. It would nevertheless conclude that counsel provided ineffective assistance by failing even to investigate a potentially disinterested alibi witness whose testimony could have created reasonable doubt, and would affirm the order granting a new trial. The writing therefore concurs in part and dissents in part from the majority.
