Supreme Court of Connecticut

Sepega v. DeLaura

September 26, 2017

Summary

The court held that Connecticut's firefighter's rule does not bar a police officer's ordinary negligence claim against a homeowner whose alleged conduct created the circumstances requiring the officer to forcibly enter the home. The rule remains confined to premises-liability claims involving defective conditions on property, and the complaint alleged no such condition. Because the complaint was legally sufficient under that rule, the court reversed the judgment entered after the motion to strike and remanded for further proceedings.
