Supreme Court of Connecticut
Robert Sepega v. Lawrence R. Delaura
September 26, 2017326 Conn. 788
Summary
The court held that Connecticut's firefighter's rule does not bar a municipal police officer's ordinary-negligence claim against a homeowner whose conduct allegedly created the emergency that required the officer to forcibly enter the home. The rule remains confined to premises-liability claims involving defects or conditions of the property, and the plaintiff alleged no such defect. The trial court therefore improperly struck the complaint, requiring reversal and remand for further proceedings.
