Supreme Court of Connecticut
Michael J. O'Brien v. Kathleen E. O'Brien
June 27, 2017326 Conn. 81
Summary
The court held that a trial court may remedy a party's violation of dissolution-related automatic orders by adjusting the marital-property distribution, even when the violation was not wilful and therefore did not support a contempt finding. The trial court reasonably valued the resulting loss as of the remand trial, provided the award did not exceed the injured spouse's reasonable loss, and properly treated the transactions as outside the usual-course-of-business exception. The court also upheld the classification of the unvested stock options as marital property and rejected the challenge to the retroactive alimony award.
