Summary

The court affirmed dismissal of the defendant’s motion to correct an illegal sentence for lack of jurisdiction. Although the motion initially presented a colorable claim that a juvenile offender had received an equivalent of life without parole without consideration of youth-related mitigating factors, subsequent legislation made the defendant eligible for parole, eliminating the alleged sentencing defect. The court therefore concluded that the defendant could no longer obtain resentencing on that ground.
