Supreme Court of Connecticut

State of Connecticut v. Connecticut Employees Union Independent — Espinosa, J., Concurring

August 30, 2016322 Conn. 713

Summary

Justice Espinosa concurred in the judgment reversing the trial court and confirming the arbitration award reinstating an employee who used marijuana at work, because precedent compelled that result. She nevertheless argued that the governing public-policy review framework is too rigid and deferential, allowing arbitration awards to escape meaningful judicial review. She would have given greater independent weight to the public message conveyed by reinstatement and treated relevant subfactors as separate considerations. As a concurrence, this opinion announces no holding of its own.
