Supreme Court of Connecticut

Standard Oil of Connecticut, Inc. v. Administrator, Unemployment Compensation Act

March 15, 2016

Summary

The court reversed the judgment dismissing Standard Oil's appeal and directed judgment sustaining it. It held that the installers and technicians were free from Standard Oil's control and direction under part A of the ABC test and that customers' homes were not Standard Oil's places of business under part B. Because all three ABC-test requirements are conjunctive, satisfying parts A and B established the relevant basis for treating the workers as independent contractors without reaching the plaintiff's alternative part B argument.
