Summary
The court held that equitable conversion transferred equitable title to the buyer when the seller signed the enforceable sales contract, even though the seller died before the mortgage-contingency period expired. The contingency was a condition subsequent affecting the buyer's obligation to proceed, not a condition precedent to the seller's duty to convey title. The court therefore reversed the Appellate Court in part and directed it to affirm authorization for the coexecutors to sell the property.
