Supreme Court of Connecticut
Marjorie Hornung v. Robert Hornung
September 20, 2016323 Conn. 144
Summary
Justice Zarella dissented from the majority's decision upholding a $7.5 million lump-sum alimony award and the enforcement of the parties' amended premarital agreement. He would have concluded that the award functioned as an impermissible property distribution because it greatly exceeded the plaintiff's support needs and required the defendant to invade assets protected by the agreement. He also would have held the amended agreement unenforceable because the defendant failed to disclose his current income when it was executed. Justice Zarella, dissenting, would have reversed the financial orders and remanded for a new hearing.
