Summary

The court held that the denial of a motion to dismiss based on a colorable claim of tribal sovereign immunity was immediately appealable. It further held that tribal sovereign immunity barred negligence claims against a tribal employee sued individually because undisputed facts established that he was acting within the scope of his employment and the plaintiffs did not show that he acted outside his authority. The court therefore reversed and remanded with directions to grant the motion to dismiss.
