The court held that terminating the plaintiff's rental assistance based on a regulation promulgated after his admission to the program was a retroactive application of the regulation because it imposed a new obligation on his previously established right to receive future benefits. The legislature had not expressly authorized the agency to promulgate retroactive rental-assistance regulations, so the trial court should have sustained the plaintiff's administrative appeal. Justice Espinosa, dissenting, would have treated the termination as prospective and affirmed the trial court.
