Supreme Court of Connecticut

Dairyland Ins. Co. v. Mitchell

January 19, 2016

Summary

The court held that an automobile liability policy exclusion for bodily injury to a named insured is invalid unless it is set forth in a separate endorsement as required by the governing statute. Because the exclusion appeared only in the body of the policy, it could not defeat coverage or the insurer’s duty to defend, and the trial court’s summary judgment for the insurer was reversed. No separate opinions were issued.
