Summary
The court held that the plaintiff presented sufficient evidence to create genuine issues of material fact concerning whether her abdominal discomfort was caused by a retained surgical sponge and whether she received continuing treatment for that condition. It further held that the continuing course of treatment doctrine does not require proof that the subsequent treatment was negligent or that the patient knew the true nature of the underlying condition. The court therefore affirmed the appellate judgment reversing summary judgment for the defendants.
