The court held that the expiration of a jurisdictional time limit for a statutory cause of action does not create immunity from suit that permits an interlocutory appeal under the second prong of the final judgment rule. Accordingly, the defendant could not immediately appeal the denial of summary judgment based on the claimed untimeliness of the wrongful death action, and the appeal was properly dismissed. The court also reaffirmed that the wrongful death limitation period must be read together with the savings statute.
