Summary

Justice Espinosa dissented from the denial of the state's motion to stay execution of the judgment pending resolution of a related appeal. The dissent reasoned that the state had not received fair notice or a meaningful opportunity to address issues on which the earlier decision rested, and that strict adherence to the ordinary procedural rules would cause injustice. The dissent would have granted the stay so the state could present its arguments without those arguments becoming practically moot.
