Summary
The court held that the 2011 legislation decriminalized possession of less than one-half ounce of marijuana for purposes of the erasure statute because it replaced criminal sanctions with minor civil fines and classified the conduct as a minor civil violation. Accordingly, the defendant was entitled to erase the records of his two prior marijuana convictions, although the court affirmed the lower courts’ rulings on the other matters because those issues were outside the certified appeal.
