Supreme Court of Connecticut

Rocky Hill v. SecureCare Realty, LLC

January 6, 2015

Summary

The court reversed dismissal of the town’s action challenging a privately owned nursing home project because the defendants were not entitled to sovereign immunity as arms of the state. The defendants’ public function and partial state funding did not overcome the absence of state creation, comprehensive state control, state personnel, and full financial responsibility for judgments. The court also held that the authorizing statute neither expressly nor impliedly preempted local zoning regulations.
