Supreme Court of Connecticut

DiLieto v. County Obstetrics & Gynecology Group, P.C.

May 19, 2015

Summary

The court held that, under the applicable version of § 37-3b, a trial court has broad discretion to select any fair postjudgment interest rate up to 10 percent and may consider potential investment income, rather than being limited to risk-free investment rates. The court also held that interest on an award of postjudgment interest begins accruing when that award is made, not when the underlying judgment was satisfied. It therefore affirmed the 8 percent award on the underlying judgment but reversed and remanded the award of interest on the postjudgment interest itself.
