Summary
The court held that a receiver appointed under the statute may use legal process to collect rent owed before the appointment date. It held, however, that the statute does not authorize the receiver to evict a defaulting tenant or lease the property to a new tenant because the receiver's statutory authority is limited to collecting payments and making specified payments from those collections. The Appellate Court's judgment was therefore affirmed in part and reversed in part.
