Summary

The court held that reinstating a certified nursing assistant who delayed reporting suspected resident abuse did not violate Connecticut public policy. Applying de novo review to the public-policy challenge, the court concluded that the governing statutes and regulations did not require termination and that the employee's conduct was not sufficiently egregious or indicative of incorrigibility to make reinstatement unlawful. The court reversed the Appellate Court and remanded for consideration of the employer's remaining claim.
