Summary
The court held that the statutory good-faith opinion requirement applies to medical-malpractice claims against institutional defendants sued vicariously for the negligence of their personnel. It further held that an opinion from a board-certified obstetrician and gynecologist satisfied the statutory requirement because nurse-midwives and obstetricians practice and are certified in the same specialty, obstetrics. The court therefore reversed the dismissal and remanded for further proceedings.
