Summary

The court held that the statute was not unconstitutionally vague as applied because the defendant had fair notice that his dirk knife and expandable police baton fell within the statutory terms and that no moving exception applied to those weapons. It nevertheless held that both weapons are protected arms and that the statute's categorical prohibition on transporting them between residences substantially burdened the defendant's right to possess them in his home without satisfying intermediate scrutiny. The court reversed the convictions and directed entry of judgments of acquittal.
