Summary
The court held that Enfield ordinances requiring abutting landowners to remove snow and ice from public sidewalks, while imposing penalties for noncompliance, did not transfer civil liability for sidewalk injuries from the town to the landowners. The plaintiff's alternative negligence theories also failed because the ordinances created a duty to the municipality, and the pleadings and proof did not show that the defendants controlled the sidewalk or created the icy condition. The court affirmed summary judgment and declined to review an unpreserved statutory claim.
