Justice Zarella concurs in part and dissents in part from the majority's disposition of the plaintiff's motion to open the dissolution judgment based on alleged nondisclosure of an unvested pension benefit. The opinion would uphold the trial court's determination that the benefit was not distributable marital property under the law existing at dissolution and that the plaintiff failed to prove fraud. It also rejects the majority's conclusion that valuation evidence was improperly excluded and that the exclusion affected the fraud determination.
