Summary

The concurrence agrees that the discovery order was not an appealable final judgment under either prong of the applicable final-judgment test and that the court therefore lacked subject matter jurisdiction over the writ of error. It disagrees with the majority's attempt to distinguish an earlier decision involving a nonparty discovery order and would instead overrule that decision as an improper expansion of the narrow exceptions to the general rule against interlocutory appeals from discovery orders.
