Summary
Justice Vertefeuille concurred in part and dissented in part. She agreed that the plaintiff acquired standing after substitution as administratrix and that the decedent's capacity to consent was a jury question, but concluded that the admission of exhibit 7 was improper because the clerk failed to provide the jury's question about it and the defendant conceded it should not have been admitted. She nevertheless would have affirmed because the error was harmless and the trial court properly denied the motion to set aside the verdict and for a new trial.
