Summary
The court held that the employment letter was ambiguous as to whether it created a thirty-six-month employment term or merely established terms for at-will employment. Because ambiguity presents a legal question subject to plenary review, the lower courts erred by treating the letter as unambiguously establishing a fixed term without considering extrinsic evidence. The judgment was reversed and the case remanded for a new trial to determine the parties’ intent; contra proferentem may be used only as a last resort.
