Summary

The court held that the guaranty association was not estopped by the insolvent insurer's preinsolvency failure to defend or reserve rights from contesting whether the Drowns' claims were covered claims. It also held that the policy unambiguously excluded coverage for the insured corporation's vicarious liability arising solely from the professional negligence of individual physicians, so the association had no obligation to pay the claims. The court therefore affirmed the Appellate Court's judgment in favor of the association.
