Summary
The court held that the police department's obligation to remain at a domestic-violence scene for a reasonable time until the likelihood of further imminent violence was eliminated required the exercise of police judgment and therefore was discretionary. Because the alleged negligence arose from discretionary conduct protected by governmental immunity, the court affirmed summary judgment for the city. The court did not decide whether the statute independently imposed a duty to remain at the scene or whether the duty was owed to the decedent.
