Justice Eveleigh, joined by Justice Vertefeuille, concurred with the conclusion that the state failed to prove the defendant intended to sell narcotics within the proscribed distance, but dissented from the conclusion that the state proved the location was within 1500 feet of a qualifying elementary or secondary school. The separate opinion reasoned that the testimony established only that the Timothy Dwight School was public and that an incomplete, objected-to answer about its grades could not supply the missing statutory element. Justice Eveleigh would have affirmed the Appellate Court's determination that the school-classification element was also unsupported by sufficient evidence.
