Summary

The concurrence agrees that the trial court properly considered the defendant's drug-dealing activities in imposing sentence. It separately concludes that considering the defendant's own truthful testimony about those activities did not impermissibly burden his constitutional right to testify because a defendant who testifies assumes the ordinary risks associated with that choice. The concurrence joins the majority opinion.
