Summary
The court held that, after reversal of one conviction in a multicount case, the trial court could restructure the defendant's sentence on the remaining conviction under the aggregate package theory, provided the revised sentence did not exceed the original sentence. It also held that the defendant's nolo contendere plea and 2004 jury-trial waiver encompassed the public-interest finding required for persistent serious felony sentencing and remained valid at the 2008 resentencing. The court therefore affirmed the resentencing judgment.
