Summary

The dissent would conclude that the trooper had reasonable and articulable suspicion to stop the defendant’s vehicle because he observed a chain hanging approximately eight to ten inches from the rearview mirror. It reasons that the stop was investigative and did not require proof that the chain actually obstructed the driver’s view or distracted him before the stop. The dissent therefore would reverse the Appellate Court’s judgment upholding dismissal of the charges.
