Summary
The court held that a defendant challenging the personal jurisdiction of a sister-state court in an action to enforce a foreign default judgment may assert the challenge as a special defense rather than through a motion to dismiss. It also held that the judgment creditor, as the summary judgment movant, had to establish that no genuine issue existed regarding the foreign court's personal jurisdiction, and failed to do so. The judgment was therefore reversed and the case remanded. No separate opinions were filed.
