Supreme Court of Connecticut

C. R. Klewin Northeast, LLC v. State of Connecticut

December 7, 2010299 Conn. 167

Summary

The court held that a contractor seeking to sue the state under General Statutes § 4-61 need not expressly state an intent to litigate or arbitrate, so long as it gives the agency head written notice that it is asserting a right to payment and identifies the factual basis for the claim. The court also held that the plaintiff's letter provided sufficient factual detail under the statute, and therefore the trial court had subject matter jurisdiction and improperly dismissed the action. The judgment was reversed and the case was remanded for further proceedings.
