Summary
The court held that the union failed to prove that the reassignment of a departing special education teacher’s caseload substantially changed a fixed and definite employment practice, because the record did not establish the teachers’ historical workloads. The court nevertheless upheld the finding of unlawful direct dealing based on the employer’s efforts to discourage the teachers from pursuing a union complaint and to obtain a statement disavowing the complaint. The judgment was therefore reversed in part and affirmed in part.
